The following relates to the use of the triangle sign for slow moving vehicles. This sign is typically found on tractor or farm implements and is sometimes seen on other vehicles and equipment such as our historic military vehicles. After some research on the topic and the Texas Transportation Code, it is my understanding that our vehicles do NOT qualify as a slow moving vehicle and therefore are in violation of the provision of use. Technically, we are not slow moving vehicles and technically, a peace officer could issue a citation of a Class C Misdemeanor with a maximum fine of up to $500 and no jail time.

The specifics from the Transportation code are noted below:

CHAPTER 547. VEHICLE EQUIPMENT

SUBCHAPTER A. GENERAL PROVISIONS

§ 547.001. Definitions

In this chapter:

(7) "Slow-moving vehicle" means:

(A) a motor vehicle designed to operate at a maximum speed of 25 miles per hour or less; or

(B) a vehicle, implement of husbandry, or machinery, including road construction machinery, that is towed by:

(i) an animal; or

(ii) a motor vehicle designed to operate at a maximum speed of 25 miles per hour or less.

(8) "Slow-moving-vehicle emblem" means a triangular emblem that conforms to standards and specifications adopted by the director under Section 547.104

§ 547.005. Offense Relating to Violation of Special-Use Provisions

(a) A person may not use a slow-moving-vehicle emblem on a stationary object or a vehicle other than a slow-moving vehicle.

§ 547.104. Slow-Moving-Vehicle Emblem Standards

The director shall adopt standards and specifications that:

(1) apply to the color, size, and mounting position of a slow-moving-vehicle emblem; and

(2) at the time adopted, correlate with and conform as closely as practicable to the standards and specifications adopted or approved by the American Society of Agricultural Engineers for a uniform emblem to identify a slow-moving vehicle.
